Semmes Man Shot by Police During Stand-Off Files Lawsuit

SEMMES, Ala. The man involved last week in a stand-off with Semmes police and the Mobile County Sheriff’s Office is now suing both law enforcement agencies after he was shot during the confrontation.
While Semmes police officers were on patrol, they noticed that a door at a business was open and while officers were investigating Johnny Bowman emerged from a camper and opened fire on the officers, promoting them to return fire. Bowman was struck five times.
After negotiating with Mobile County Sheriff’s deputies for two hours, Bowman came out of the garage and was taken to the hospital.
Bowman has since hired a local law firm, Tobias & Comer, who has released a statement on Bowman’s behalf.
In the statement, the law firm said that police had no right to be on private property and was in essence, trespassing.
The statement further stated that “All citizens are entitled to the right to be free from unlawful entry into their home or business and to be protected from police misconduct.”
“Johnny is committed to ensuring that those responsible are held accountable and to doing what he can to prevent this from happening to other law-abiding citizens in the future.”
During the shooting, a Semmes police officer was also grazed by Bowman’s shots, but the officer was not seriously injured.
However, the law does allow law enforcement to enter a property to investigate suspicious or criminal activity without a warrant under the “Exigent Circumstances Doctrine”.
