A mother charged with killing her son in 2022, pleaded guilty to manslaughter but will only serve 3 years of formal probation. She was credited for time served.
She waived the trial that was scheduled to begin this week
Glenda Agee killed her 13-year-old son, Ja’mil Autry while he was asleep in his bedroom at their home on Jones Lane in the Plateau community according to police.
But the investigation showed that it was not intentional, but it was reckless conduct with a firearm.
District Attorney Keith Blackwood called the shooting a tragedy.
“She was recklessly handling a gun while in her bathroom. She pulled the trigger through that reckless handling and the bullet went through the wall and into her son who was lying on the bed in his bedroom,” Blackwood said.
His sister, Tiffany Epps, says they stand firmly behind the fact that this was a terrible accident that resulted in tragedy and supports the mother.
“It was an accident. She loves him. She really did. It was an accident, accidents happen you know,” Epps said.
Blackwood stated in court that although it was not intentional, Agee knowingly or should have known that the handling of a loaded firearm in such a manner could result in someone being injured and, in this situation, they were killed.
“I believe they do see this as an accident however I think the evidence was clear that Ms. Agee was acting recklessly with the gun,” Blackwood said.
During testimony in 2022, Mobile Police testified officers had been called to Agee’s address on Jones Lane more than thirty times including 911 hang-ups, assault complaints, and medical emergencies.
In addition to the three years of formal probation, Agee will have mental health treatment as well as drug and alcohol treatment.
