Almost a year has passed since a motorcyclist was killed in a collision with a Mobile police vehicle.
Robert Sayen and Mobile Police Officer Paul Callegari collided at the intersection of Cody Road and Zeigler Boulevard.
An investigation into the accident and a Mobile Grand jury found no criminal liability on the part of Callegari and cleared him of any wrongdoing.
But now, the family of Sayen has filed a legal claim against the city of Mobile and the police officer, alleging that the police officer was operating negligently.
The six-page claim alleges that Callegari was going 16 miles over the speed limit when he approached a malfunctioning yellow traffic light.
“Had defendant Paul Anthony Callegari Jr. proceeded through the intersection of Cody Road and Zeigler Boulevard with caution, or maintained his lane of travel, or even just driven the speed limit, Robert Sayen would have safely crossed the intersection without incident,” the lawsuit reads in part.
The city of Mobile and the Mobile Police Department cannot comment on the new lawsuit.
