BALDWIN COUNTY, Ala. A recent statewide poll shows that Alabamians are strong supporters of private property rights and many in recent months have voiced their dismay on social media highlighting the increase of trespassing, especially in Baldwin County.
In one Facebook post in June, Madeline said that her doorbell camera had captured two different people entering her property and her barn. One person was seen on her porch peeping into her windows.
She said that she called the law, but they wouldn’t even write a report saying that a crime had not taken place.
And from a legal standpoint, the officer was correct.
In Alabama, when the property is not posted “No Trespassing”, or does not have a secured fence or the trespasser hasn’t been previously warned, prosecution of the crime trespassing rarely occurs.
However, had the person entered a locked gate, or a locked building, the charge could have been escalated from trespassing to burglary, which is a felony.
During this summer, people on social media including Facebook, Twitter and Nextdoor all complained about people trespassing on and through their property, some even posting videos of the person and their vehicles.
As the area’s population grows and people are moving and building closer together, trespassing will continue to increase.
We recently wrote a news article on the law of trespassing by motor vehicles. Leaving your vehicle parked on someone else’s property including that of a business, could not only get your vehicle towed, but the owner could be issued a misdemeanor citation for trespassing.
Trespassing along with other property crimes is listed as one of the fastest areas of crime in Alabama.
