“Slow Rolling” is Still Eluding Police

A term used by police nationwide “slow-rolling“, meaning that the driver of a vehicle is failing to yield to a police officer’s lights and sirens, and not pulling to the right as required by law in all 50 states, has been the theme for several recent traffic stops in both Mobile and Baldwin Counties.

Some drivers believe that it’s okay to keep driving home or to grandma’s house as long as they don’t speed or as long as they have their hazard lights flashing. But driving slow is still considered to be “eluding” a police officer.

When blue or red or blue and red lights are flashing and sirens are sounding, a driver must pull to the right and give the emergency vehicle the right of way and that includes when law enforcement is stopping the vehicle for a moving violation.

In Alabama, it shall be unlawful for a person to intentionally flee by any means from anyone the person knows to be a law enforcement officer if the person knows the officer is attempting to arrest the person.

It shall be unlawful for a person while operating a motor vehicle on a street, road, alley, or highway in this state, to intentionally flee or attempt to elude a law enforcement officer after having received a signal from the officer to bring the vehicle to a stop.

Eluding or attempting to elude a police officer is a Class A misdemeanor unless the flight or attempt to elude causes an actual death or physical injury to innocent bystanders or third parties, in which case the violation shall be a Class C felony.

Drivers sometimes think that if they can make it home, they’re free and police can no longer stop them, cite them, or arrest them, but that also is incorrect.

Sometimes an elderly driver, a female, or a young driver doesn’t stop right away because they feel it’s not a safe location or they’re not sure that it is a “real” police officer trying to stop them.
In those situations, it is recommended that drivers stop in a lit area, call 911 to verify that police are trying to stop them, and not escalate the situation.

Drivers flee from law enforcement for many reasons including that they have outstanding arrest warrants, illegal narcotics or they’re intoxicated.

Almost daily, drivers are arrested for eluding police in our area.

Just pull over, cooperate with law enforcement, and most of the time, you’ll soon be on your way.
